BRYND MEDIA — Refunds & Cancellations Policy

This policy applies to all BRYND MEDIA services, including branding & identity, marketing, creative design, videos, websites, automation, events, consulting, and statutory/legal support. By engaging BRYND MEDIA and making a payment, you agree to the following terms:

1) Advance Payments

  • All projects require 50%–70% advance, and in high-value/urgent/custom work up to 90% advance.

  • Advances are used immediately to block resources (strategists, designers, developers, videographers, ad budgets, licenses, vendors).

  • As per Indian Contract Act, 1872 (Sections 73–74), advances are treated as genuine pre-estimates of loss/liquidated damages, not as penalties, and are appropriated in case of cancellations.

2) Client Cancellations

  • Cooling-off window: Cancellations allowed only within 2 hours of payment. Refund (if any) will exclude gateway/bank charges and costs already committed.

  • After 2 hours: No cancellation or refund possible, as resources, creatives, and vendors are allocated.

  • Advance is appropriated towards:

    1. Actual committed costs (ads, hosting, domains, software, production, freelancers, vendors),

    2. Professional hours (strategy, discovery, audits, drafts, designs, shoots, edits), and

    3. Liquidated damages for blocked capacity and opportunity loss, capped at the advance.

3) BRYND MEDIA Cancellations

If we must withdraw due to force majeure, conflict of interest, or technical infeasibility, we will refund the unused portion of advance after deducting actual committed costs.

4) Strictly Non-Refundable Services

The following are non-refundable under all circumstances once initiated:

  • Company registrations, government filings, licenses, notary/legal costs

  • Trademark/IP applications

  • Creative designs, brand identities, logos, drafts, mockups, artworks

  • Video shoots, edits, animations, photography, production hours

  • Ad/media spends, influencer fees, vendor bookings

  • Domain/hosting, SSL, business emails, software/plugins, paid APIs

  • Printing, fabrication, stall/venue bookings, event materials

  • Audits, discovery workshops, initial strategies

5) Retainers & Subscriptions

  • Retainer and monthly contracts (SEO, SMM, automation support, content) are non-refundable once the cycle begins.

  • Clients may cancel future cycles with at least 7 days’ notice before the next billing.

6) Refund Process

  • Requests must be emailed to contact@bryndmedia.com with invoice details and reason.

  • We respond in 3–5 business days; if eligible, refunds are processed in 7–10 business days to the original payment method.

  • Payment gateway, bank, and admin charges are non-recoverable.

7) Chargebacks & Abuse

  • Clients must first contact BRYND MEDIA before raising disputes.

  • Unauthorized chargebacks may lead to service suspension and legal recovery of damages, including costs.

8) Legal Validity

  • E-Contracts: Acceptance of proposals and payments constitutes a valid electronic contract under the Information Technology Act, 2000, Section 10A.

  • Damages: Refunds and forfeitures are governed by Indian Contract Act, Sections 73–74 — limited to reasonable compensation, not penal.

  • Consumer Protection Act, 2019: B2B clients primarily apply; however, statutory consumer rights (if applicable) are unaffected.

9) Dispute Resolution & Jurisdiction

  • All disputes are subject to arbitration under the Arbitration & Conciliation Act, 1996.

  • Seat/Venue: Bengaluru, Karnataka.

  • Language: English.

  • Subject to arbitration, the courts of Bengaluru, Karnataka shall have exclusive jurisdiction.

10) Intellectual Property & Deliverables

  • Final source files, videos, designs, code, and admin access are released only after full and final payment.

  • If a project ends early, work-in-progress remains BRYND MEDIA property unless otherwise agreed in writing.

This policy may be revised periodically; the version on our website applies at all times.
